1. Introduction
Welcome to FreshStreamHub ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at freshstreamhub.sbs (the "Service") operated by FreshStreamHub.
By reserving a charter or accessing our Service, you accept these Terms. Should you not agree with any part of these terms, then you are not permitted to use the Service.
2. Service Overview
FreshStreamHub offers top-tier yacht charter services, which include but are not limited to:
- Day-long yacht hires
- Evening boat tours
- Business retreats
- Exclusive gatherings
- Extended charters
All offerings are contingent on availability and meteorological conditions. We reserve the right to adjust or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To finalize a charter reservation, you must:
- Be a minimum age of 18 years
- Furnish truthfully complete details
- Settle the required advance payment as detailed in your confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs only after payment is received and we provide written acknowledgment. We maintain the right to reject service to anyone at will.
3.3 Availability
All yacht reservations are subject to the vessel's availability and appropriate weather conditions. We will endeavor to fulfill your requested dates and timing.
4. Payment Terms
4.1 Pricing
All listed fees are in € and incorporate all relevant taxes unless stated otherwise. Pricing is subject to alteration without forewarning.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire charter expense, due at time of reservation
- Remaining Balance: Payable 48 hours before the charter starts
- Supplementary fees (if applicable): Payable after the charter is complete
4.3 Payment Methods
We accept several major credit cards, electronic bank transfers, and verified cheques. Payments are processed via secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Above 72 hours before departure: Complete refund minus transaction fees
- Between 24 to 72 hours before departure: Half refund
- Inside 24 hours prior to departure: No refund possible
5.2 Weather Cancellations
Should weather conditions be judged insecure by our captain, we will propose to either:
- Change the date of your booking to another suitable day without extra cost
- Issue a complete refund if rescheduling isn't feasible
5.3 Mechanical Issues
In case there's a mechanical failure with your designated yacht, we'll attempt to supply an acceptable replacement. If we can't offer an alternative, we will issue a total refund.
6. Safety and Conduct
6.1 Safety Requirements
Every traveler must:
- Abide by instructions given by the crew
- Utilize the provided safety gear when mandated
- Disclose any medical conditions that could impact their well-being
- Stay within the allotted areas on the vessel
6.2 Prohibited Items
The ensuing items are forbidden on board:
- Glass bottles or jars
- Unlawful items
- Weapons or harmful objects
- Excessive consumables (beyond reasonable quantity)
- Animals (unless given prior consent)
6.3 Conduct
Guests are expected to behave respectfully. We reserve the prerogative to conclude a charter without refund if a guest's actions present a hazard or impinge on the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the sums paid for your booking. We are not liable for:
- Bodily harm stemming from the client's carelessness
- Theft or destruction of personal possessions
- Secondary, consequent, or exemplary damages
- Delays provoked by weather or other circumstances that are out of our hands
7.2 Insurance Coverage
We keep extensive marine insurance that encompasses our fleet and operations. Clients are accountable for arranging their travel and personal insurance coverage.
7.3 Assumption of Risk
By partaking in our charter facilities, you recognize that marine activities carry inherent risks and you accept accountability for your safety and health.
8. Modifications and Itinerary Changes
We retain the right to adjust itineraries, courses, or schedules due to weather considerations, safety needs, or operational demands. We will strive to offer suitable equivalent experiences.
9. Force Majeure
We absolve responsibility for delays, cancellations, or alterations derived from events outside of our influence, which include but are not limited to:
- Extreme meteorological conditions
- Acts of god
- Government decrees
- Port blockages
- Technical breakdowns
10. Privacy and Data Protection
Your personal data management aligns with our Privacy Policy. By using our facilities, you agree to our data collection and usage as outlined in our Privacy Policy.
11. Intellectual Property
All materials on our site, such as texts, graphics, emblems, and imagery, are secured under copyright and trademark statutes. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our prior written consent.
12. Governing Law
These Terms are sanctioned by the laws in force in Germany. Disputes will be adjudicated in the courts of Hamburg, Germany.
13. Changes to Terms
We reserve the capability to revise these Terms at any interval. Amendments will be published on our site along with the new version date. Persistent usage of our services indicates acceptance of the revised terms.
